Recreational Minor Hockey
         By-laws 
 

RMHA Rules are in place as guide lines. They are currently under review by the Board of Directors and will be revised shortly.

Article I: Membership

For the purpose of voting at the Annual General Meeting and/or holding an elected office, members of Recreational Minor Hockey shall be defined as parents/guardians, coaches, assistant coaches, support staff, members of the Board of Directors of Recreational Minor Hockey, or referees who have been actively involved in Recreational Minor Hockey during the previous hockey season (April 1- March 31). Each member, having attained the age of majority, shall have one (1) vote at the Annual General Meeting.

Article II: Quorum

A quorum at an Annual General Meeting shall be defined as all eligible voting members present. At the monthly meeting of the Board of Directors of Recreational Minor Hockey, a quorum shall be defined as five (5) members.

Article III: Duties of the Board of Directors of Recreational Minor Hockey

 

(1) President – The President shall preside over all meetings of the Board of Directors of Recreational Minor Hockey and shall act as spokesperson for the League. The President shall not have voting power at a monthly Board meeting or Annual General Meeting except where his/her vote shall affect the outcome of a motion. The President may not coach or manage a team or be a referee in the league.

 

(2) Vice-President – The Vice-President shall assume full powers of the President in his/her absence. The Vice-President shall act as coordinator for the coaches’ and referees’ clinics, and shall coordinate other educational activities as decided by the Board of Directors. The Vice-President shall submit applications as required for funding to the City’s Parks and Recreation Commission. The Vice-President shall initiate, facilitate, and coordinate special events as needed. The Vice-President may coach, manage a team or be a referee in the league.

 

(3) Secretary – The Secretary shall be responsible for recording and maintaining accurate minutes of all Board meetings and the Annual General Meeting. He/she shall provide the minutes to the Board of Directors of Recreational Minor Hockey and shall post them in an appropriate, conspicuous location at the Niagara Falls Memorial Arena. The Secretary may coach, manage a team or be a referee in the league.

 

(4) Treasurer – The Treasurer shall keep a full and accurate account of all receipts and disbursements of the league in proper account books and shall deposit all monies in the name of the league. The treasurer shall report to the Board of Directors of Recreational Minor Hockey at the regular monthly meetings or whenever required. The Treasurer shall act as Registrar during registration periods. He/she shall hand over all financial documents and books for review at year-end and shall provide a yearly financial statement at the Annual General Meeting. The Treasurer may coach, manage a team or be a referee in the league.

 

(5) Parent Liaison – The Parent Liaison shall represent the wishes and concerns of the parents of players currently in Recreational Minor Hockey. The Parent Liaison may coach, manage a team or be a referee in the league.

 

(6) Division Convenors, (Atom, PeeWee Bantam and Midget) – Each of the divisions shall have a convenor who will oversee the operation of that division. He/she shall be present at each divisional game and shall keep accurate team lists and statistics for each game. The Convenors shall have such statistics available at each monthly Board meeting. Convenors shall not coach or manage in their division. Convenors may referee in any division.

(7) Immediate Past President – The Immediate Past President shall extend guidance and support to the executive team. The primary responsibility of this role involves serving as a resource for new officers and ensuring continuity with past terms. The Immediate Past President chairs nominating committees, promotes the Board of Directors efforts and assists in preparing documentation of league procedures. Since this is an advisory position only, it is not a voting position.  

In addition to the above-specified duties, each Board member may have such other duties applicable to the office as prescribed by the parliamentary authority adopted by this Association.

The Board of Directors shall be charged with the management and responsibility for the organization of Recreational Minor Hockey. The Board shall, from time to time, establish the objectives of the organization and determine the policies for the development of such objectives, based on the defined purpose of Recreational Minor Hockey (Article II of the Constitution).

Members of the Board of Directors of Recreational Minor Hockey are expected to attend at least fifty percent (50%) of all regularly scheduled monthly Board meetings, and in addition, must not miss more than three (3) consecutive monthly meetings; failure of which may result in expulsion from the Board if approved by a two-thirds vote of the Board of Directors. The duties of the expelled Board member shall be assigned to other members of the Board for the remainder of his/her term in office. In addition, any expelled Board member shall not be allowed to run for any position on the Board of Directors of Recreational Minor Hockey for a period of one (1) year following the date of the expulsion.”

Article IV: Signing Authority

 

The President, Vice-President and the Treasurer shall have signing authority on all cheques. There shall be two (2) signatures on each cheque, one of which must be that of the Treasurer.

In the event that the Treasurer, for whatever reason, is unable to fulfill his/her cheque signing obligations as required above, the President and the Vice-President, upon approval of a majority vote of the Board of Directors, may subsequently both sign any and all required cheques, until such time as the Treasurer is able to resume his/her cheque signing obligations.

Article V: Duties of Support Staff

 

The support staff shall consist of:

 

(1) Equipment Manager

(2) Sponsorship Chairman

(3) Public Relations Chairman

(4) Referee-in-chief

(5) Referees

(6) Coaches

(7) Assistant convenors

(8) RMHA Auxiliary Chairperson

The above members shall be appointed by the Board of Directors of Recreational Minor Hockey. Their duties shall be defined from time to time by that Board. They are permitted to attend the monthly meeting of the Board of Directors but shall not have voting rights at the meeting. The Board of Directors of Recreational Minor Hockey shall appoint, if desired, an assistant convenor in each division upon the recommendation of that divisional convenor.

Members of the Board of Directors of Recreational Minor Hockey may occupy, if they so desire, support staff positions, in addition to their Board positions, upon agreement by a majority of the Board of Directors of Recreational Minor Hockey. Such persons shall retain their right to vote as a Board Member.

Article VI: Meetings

 

(1) The regular meeting of the Board of Directors shall be held on the last Tuesday of every month. In the event of a lack of a quorum, the regular meeting will be postponed until the following Tuesday.

 

(2) The date of an upcoming monthly general meeting may be changed by a simple majority in the event that the scheduled meeting date falls on a legal holiday, or for other special reasons.

 

(3) The Annual General Meeting will be held each year during the time period from the first until the fifteenth of April. The Annual General Meeting shall be open to all current members of Recreational Minor Hockey as defined in Article I of the By-laws.

 

(4) Special meetings may be called by the chair, or by the chair at the request of any member, for the transaction of only such business as is stated in the call for the meeting.

 

(5) In the case of an emergency, action may be taken by the Board of Directors by telephone concurrence by a majority of the Board members. This telephone concurrence must be upon the call of the chair, or by the chair at the request of any Board member. At least seventy-five percent (75%) of the members of the Board must be available to transact this telephone polling. Such action shall be noted in a special memo and placed in the minute book and signed by the person obtaining such concurrence and shall be reported in the minutes of the next meeting.

 

(6) Prior to the start of league play, a meeting will be conducted with all coaches, assistant coaches, and referees to review playing rules, disciplinary regulations, and miscellaneous rules for the upcoming year.

 

Article VII: Parliamentary Authority

 

The rules contained in the current edition of Robert’s Rules of Order Newly Revised shall govern the organization in all instances when they are applicable and not inconsistent with the by-laws and any other special rules the organization shall adopt.

Article VIII: Rules & Regulations

 

The Rules & Regulations shall be determined by the Board of Directors of Recreational Minor Hockey and shall be reviewed annually. The coach/assistant coach shall Communicate the playing rules at the beginning each year.

Article IX: Amendments to the By-laws, Rules & Regulations

 

The By-laws and Rules & Regulations may be amended at any regular meeting of the Board of Directors of Recreational Minor Hockey by a two-thirds vote, provided that the proposed amendment has been submitted in writing at the previous regular meeting.”

Article X: Registration

 

Times of registration and registration fees shall be determined by the Board of Directors of Recreational Minor Hockey annually and shall be posted by the end of January each year.

 

All refunds, including players dropping out due to injury, will be pro-rated based on the amount of ice-time already used by the player, at a cost of $5./hr., upon return of the jersey and socks, provided that the position is able to be immediately filled by another applicant.

 

Late Starts – All late start fees shall be the full registration fee up to October 31st; afterwards, it will be prorated based on the ice time already used, at a cost of $5.00/hr.

 

A $25 non-refundable administration fee shall be charged on all refunds after July1st of each year.

 

A policy regarding refunds in the event that a registered player withdraws from Recreational Minor Hockey will be drawn up the Board of Directors of Recreational Minor Hockey prior to August 1 of each year.

 

The total number of players allowed in Recreational Minor Hockey shall be determined annually by the Board of Directors. Registration in the upcoming year shall first be offered to those players currently registered in Recreational Minor Hockey Association followed by an open registration until the total allotted number of players is registered at which time registration will be closed.”

Article XI: Sponsorships and Funding

 

Commercial sponsorship amounts per team and per division shall be determined annually by the Board of Directors of Recreational Minor Hockey.

 

Article XII: Disclaimer

 

(1) No amendments to the By-laws or other rules or motions are permitted that in any way conflict with the Constitution.

 

(2) Officers, directors, employees, and agents of the organization are indemnified for any costs, expenses, or liabilities necessarily incurred in connection with the defense of any action, suit, or proceeding in which they are made a party by reason of being or having been a member serving in an elected or appointed capacity.

 

(3) No member or employee shall be indemnified when judged in the action or suit to be liable for negligence or misconduct in the performance of duty.

 

Article XIII: Conflict of Interest

 

Any member of the Board of Directors of Recreational Minor Hockey with a conflict of interest must declare the conflict of interest and refrain from voting on that issue.

 

Article XIV: Disbandment of Recreational Minor Hockey

 

In the event that this league is disbanded, all real property and equipment shall be transferred to the City of Niagara Falls for disbursement as they see fit. In the event that a new recreational minor hockey league is subsequently formed, the above real property and equipment shall be donated to the said new league.

 

Article XV: Nomination(s) In Writing Prior To The Annual General Meeting

 

Any member in good standing of the Recreational Minor Hockey who wishes to stand for any position(s) on the Board of Directors, but who is unable to attend the Annual General Meeting(AGM), must supply in writing to the Board of Directors, at least one month prior to the AGM, a letter of intent stating which position(s) he/she wishes to run for. To stand for office the persons’ name must still be nominated and seconded from the floor during the AGM.
